Terms

The short version

• These terms are an agreement between you and Virtascend Ltd, the UK company that runs HonestFunnels. They apply when you ask for a free preview, and when you order a funnel build.
• HonestFunnels is for businesses, wherever they are. You use it for your business, and you’re 18 or over.
• The free preview is free, with up to 3 changes. It’s designed by AI, and shows what your funnel could look like: it isn’t a page to use.
• A funnel build is one fixed price, $497, paid once. We build your funnel on our own systeme.io account, then send you a link that copies it into yours, so we never need your login.
• Once you’ve paid, the pages, copy and design we make for you are yours to use, and once you can no longer get a refund, they’re yours outright. If you take a refund, your right to use them ends.
• You can get a refund within 14 days of paying, as our Refunds policy explains.
• Copy your funnel into your account within 30 days of our link, and answer us within 60 days when a step waits on you: parts 7 and 14 say what happens if you don’t.
• We don’t promise results. No funnel can promise sales.
• These terms are governed by the law of England and Wales.

1. About these terms

These terms apply to everyone who uses honestfunnels.com (“HonestFunnels”), asks for a free preview or orders a funnel build. HonestFunnels is run by Virtascend Ltd (“we”, “us”), a private limited company registered in England and Wales, company number 15192371, registered office Lytchett House, 13 Freeland Park, Wareham Road, Poole, BH16 6FA, United Kingdom. Contact us by email at hello@virtascend.com, or by post at our registered office.

You agree to these terms when you ask for a free preview, and again when you pay for a build: both say so beside the button. If you don’t agree, please don’t use HonestFunnels.

Our Refunds policy is part of these terms. Our Privacy policy explains how we use personal data: it tells you what we do, and isn’t part of this agreement.

2. Who HonestFunnels is for

• Businesses, anywhere. HonestFunnels is for coaches, consultants, creators and others who sell online, in any country. When you ask for a preview or order, you confirm that you’re doing it for your business, or for one you’re starting, not as a consumer, and that you’re 18 or over. If you order for a company, you confirm you’re allowed to agree to these terms for it.
• If the law treats you as a consumer all the same, you have the rights it gives consumers where you live, and nothing in these terms takes them away.
• Sanctions. We can’t work with anyone UK sanctions stop us working with, or for a business in a country or region they cover. By asking for a preview or ordering, you confirm that’s not you.
• Builders. We build funnels in systeme.io. ClickFunnels is coming soon: you can get a free preview for it now, but you can’t order a ClickFunnels build yet. If you use another builder, pick “Something else” in your free preview and we’ll tell you honestly whether we can help, before you pay anything.

3. The free preview

• One for each email address. You answer a few questions, and our AI designs the main page of your funnel from your answers. We email you its private link, and one follow-up about it. You can ask for up to 3 changes, free, and you’re under no obligation to order.
• It shows what your funnel could look like. You see it as pictures marked PREVIEW, and if you order, we tailor it with you before we build. It’s checked automatically before you see it, but it may still have mistakes, so please don’t rely on anything in it.
• It’s ours until you order. You can look at it and show it to anyone helping you decide, but you can’t build a page from it, or use its design or words anywhere else, unless you’ve ordered your build.
• Some businesses we don’t design for: illegal goods or services, adult content, weapons, gambling, get-rich-quick or pyramid schemes, and medical cures. A preview for one of these is declined. A preview can also take longer than usual when many are asked for at once.
• Previews nobody orders are deleted 90 days after they were asked for, as our Privacy policy explains.

4. How we use AI

• AI designs your free preview from your answers, and if you order, your funnel starts from that design. It gets your answers about your business, not the name and email address you give us, and its provider doesn’t use them to train its models.
• The one thing AI decides on its own is whether your answers look like a business we don’t design for (part 3): if they do, it declines your preview. If you think it got that wrong, email hello@virtascend.com with your preview’s reference, and a person on our team will look at it again. Apart from that, AI decides nothing about you. A person on our team builds your funnel, and checks it before it comes to you.

5. Ordering and paying

• After your preview, press “Get my quote” to see the price, then “Start my project” to order. On Stripe’s secure page you can check and correct your details, then pay. The price is $497, in US dollars, paid once through Stripe.
• Tax. We don’t add any tax at checkout. If your country taxes services bought from abroad, for example VAT under the reverse charge, accounting for it is up to you. If we ever have to charge tax, we’ll show it before you pay.
• If your card is in another currency, your bank may charge you for the conversion.
• Our agreement for your build starts when your payment goes through. We email you a confirmation with a link to your order’s page.
• If we can’t build your funnel, for example because your business is one we don’t design for, or because it would break the law or the rules of systeme.io or of your payment provider, we tell you and refund you in full, whenever that is.

6. What your build includes

• A design you approve before we build, based on your preview
• Up to 6 pages, built on our systeme.io account and shared to yours
• Copy written in your voice
• Help planning your upsells and downsells
• Checkout and emails set up
• Testing on phones and at checkout
• 3 rounds of changes to your design
• 30 days of fixes after launch, with replies within 1 working day

Anything else, such as more pages, another product or a change after the 30 days, is new work. We’ll quote it up front, and you’re free to say no.

7. How the build works

• Kickoff: after paying, you tell us what you sell, send us your logo (or tell us you don’t have one) and any pages you like. Your 3 working days start when you’ve finished.
• Day 1: we send your design, based on your preview, for your OK. The clock pauses while we wait for your answer. You can ask for up to 3 rounds of changes to the design before you approve it.
• Day 2: we build your pages, checkout and emails.
• Day 3: we send you a link that copies your funnel into your systeme.io account, and go live with you.
• For 30 days after launch: if anything breaks or doesn’t work as agreed, we fix it, free.

Working days are Monday to Friday, other than bank holidays in England and Wales. We count them in London time, wherever you are. If we’re going to be late, we’ll tell you why, and when your funnel will be ready. Once you’ve copied your funnel into your account, we remove it from ours.

Please copy it within 30 days of our link. We’ll remind you a week before, and after 30 days we remove it from our account, which has room for only a few funnels at once, and the link stops working. We keep everything we need to build it again: ask within a year of paying, and we build it again and send you a new link, free.

8. What you do

• Have a systeme.io account of your own: its free plan is enough. If you don’t have one yet, we’ll show you how to make one after you pay. If you make it through a link from us, systeme.io may pay us a commission. It costs you nothing.
• Connect what a funnel can’t take with it, in your own account:
  • Your payment account, Stripe or PayPal, so checkout pays you.
  • The name and email address your emails come from.
  • Your own domain, if you want one. Otherwise your pages keep their free systeme.io address.
• Answer our questions and look at your design in good time. While we wait for your OK, the clock waits too.
• Check everything before you approve it. You’re responsible for your products and prices, for what your funnel says about your business, and for following the laws that apply to your business and your funnel wherever you sell, such as consumer, advertising, tax and data protection laws. We don’t give legal advice.
• Your funnel’s own legal pages are yours to add. Your build doesn’t include terms, a privacy policy or a refund policy for your funnel.
• Your customers’ details are yours. Your funnel collects them in your own systeme.io account, and you’re responsible for them. We never log in to your account, so we never see them.

We write honest copy, so we won’t invent numbers, reviews or countdowns for you, or promise results your business can’t back up.

9. What you send us

Your logo, pictures, words and anything else you send us stay yours. You allow us to use them to design your preview, and if you order, to build and support your funnel. You confirm that you’re allowed to send them to us, and that using them as you’ve asked won’t break the law or anyone else’s rights. We can decline anything that would.

We keep what you tell us about your business private: we share it only with the services that help us design and build your funnel, or when the law requires it, and never use it for anyone else.

10. Your funnel, once you’ve paid

• From the moment you pay, you can use, change and copy the pages, copy and design we make for you, for your business, and let anyone working for you do the same, with nothing more to pay. Your funnel runs in your own account, so if we stopped working together tomorrow, nothing would break.
• Once you can no longer get a refund, because the 14 days have passed without your asking for one, your request has lapsed or you’ve told us you won’t ask, we transfer to you the copyright and any other rights we have in the pages, copy and design we make for you, so they’re yours outright. We do it by email, signed for Virtascend Ltd, so you have the transfer in writing: keep that email. Nobody who works on your funnel will claim any moral rights in it.
• If you ask for a refund within the 14 days, the pages come down as our Refunds policy explains, and your right to use them ends when we refund you.
• What stays ours: our own tools, templates, styles and know-how, which we use for everyone. You can use, change and copy what of them is in your funnel, for your business, free and for as long as you like, and let anyone working for you do the same, but not sell or share them on their own. If you take a refund, this ends too.
• Other companies’ parts, such as fonts and systeme.io’s own elements, stay theirs, and you use them under their terms.
• We never reuse your brand, your logo or the copy we write for you for anyone else.

11. Refunds

You can get a refund within 14 days of paying. Our Refunds policy says how, and is part of these terms.

12. Other companies’ services

systeme.io, Stripe, PayPal and the other services your funnel uses are run by other companies, under their own terms. We’re not responsible for their outages, for changes to their features or prices, or for what they decide about your accounts. If a change at systeme.io breaks something we built during your 30 days of fixes, we fix it. We’re not responsible for delays or failures caused by events outside our reasonable control.

13. Our responsibility for loss

• We do the work with reasonable care and skill, as these terms describe.
• What we never limit: our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn’t allow us to limit.
• Rights you can’t lose. Some countries’ laws give businesses rights that a contract can’t take away, such as the guarantees of the Australian Consumer Law. Nothing in these terms takes those away. Where the law lets us limit them, we limit our liability to doing the work again, or paying what it would cost to have it done again.
• No promise of results. We don’t promise that your funnel will make sales, or any amount of money.
• Apart from that, we aren’t liable for any loss of profit, revenue, sales, business, goodwill or data, or for any indirect or consequential loss. Our total liability to you for everything to do with these terms is limited to what you’ve paid us, or £100 if you haven’t paid us anything.

14. Ending our agreement

• You can end it with a refund, as our Refunds policy explains.
• We can end it if you seriously break these terms, for example by sending us something you’re not allowed to (part 9). Whatever the reason, if we end it before we’ve sent you the link to your funnel, we refund you in full, unless the law doesn’t allow it. If we end it after that, you keep your funnel and what part 10 gives you.
• If we don’t hear from you. When a step waits on you, we remind you after about 14 days and again after 42. If 60 days pass without an answer: before you’ve finished kickoff, we end our agreement and refund you in full; with your design waiting for your OK, we take it as approved and build your funnel; with your funnel copied into your account but not live yet, we take it as live, and your 30 days of fixes start. Answer us before then, and we carry on as usual.
• Parts 10 (for a build you’ve paid for and kept), 13, 16 and 17 keep applying after it ends.

15. Changes to these terms

We may change these terms, for example when the law or our service changes, and we’ll update the date at the top. A change never applies to a build you’ve already ordered or a preview you’ve already asked for: each stays under the terms you agreed to then.

16. Complaints and disputes

If you’re unhappy with anything we’ve done, tell us: email hello@virtascend.com, or write to us at our registered office, Lytchett House, 13 Freeland Park, Wareham Road, Poole, BH16 6FA, United Kingdom. We reply within 1 working day, and do our best to put it right.

These terms, and any dispute or claim about them or our work for you, including one that isn’t about the contract itself, are governed by the law of England and Wales, and the courts of England and Wales alone can settle it. If the law treats you as a consumer, you can also go to the courts where you live, and keep the protection of the laws there.

17. General

• The whole agreement. These terms, with our Refunds policy and what the price page lists for your build, are the whole agreement between us about it. If the price page or the short version above seems to say something different, the numbered parts of these terms apply.
• Language and records. These terms are in English, the only language we offer. We keep every version of them, and a record of your order: ask us for either.
• Transfer. We may transfer this agreement to another organisation, for example if HonestFunnels is sold. We’ll tell you, and it won’t reduce your rights. You can transfer it only if we agree.
• Other people. Nobody else has any rights under these terms (Contracts (Rights of Third Parties) Act 1999).
• If part of these terms is invalid, the rest still applies.
• If we don’t enforce a right straight away, we can still enforce it later.
• Notices. We contact you at the email address you gave us, and you can contact us at hello@virtascend.com. An email counts as received when it’s sent, unless the sender is told it didn’t arrive.
